1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and Trillium Community Help Foundation Inc. ("TCHF," "we," "us," or "our"), a CRA-registered charitable organization (Registration No. 748751344RR0001) incorporated under the laws of Canada, with its registered office at 210-2030 Bristol Circle, Oakville, Ontario L6H 0H2.

By accessing or using our website at www.tchf.ca (the "Website"), submitting any form, registering for any program, making a donation, applying to volunteer, or otherwise interacting with our online services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree with any part of these Terms, you must immediately discontinue use of the Website.

2. Eligibility

You must be at least 16 years of age to use this Website. By using the Website, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are using the Website on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Use of Website

You agree to use the Website only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Website in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Website
  • Attempt to gain unauthorized access to any portion of the Website, its servers, or any systems or networks connected to the Website
  • Use any automated system, including robots, spiders, scrapers, or offline readers, to access the Website for any purpose without our express written consent
  • Submit false, misleading, or fraudulent information through any form or communication
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
  • Use the Website to transmit any unlawful, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website without our express written permission
  • Use the Website in violation of any applicable federal, provincial, municipal, or international law or regulation

We reserve the right, in our sole discretion and without notice or liability, to restrict or terminate your access to the Website for any reason, including for violation of these Terms.

4. Program Services

TCHF offers various charitable programs including, but not limited to, Consumer Rights Awareness and Support, Shovel For Seniors, HealthEssentials, CareerConnect Canada, Blood Donation Support Initiative, and Immigration Help & Awareness. All programs are subject to the following terms:

  • Program availability, eligibility criteria, scope, and delivery methods are determined by TCHF in its sole discretion and may be changed, suspended, or discontinued at any time without prior notice.
  • Registration or application for a program does not guarantee acceptance or participation. TCHF reserves the right to accept or decline any registration or application at its sole discretion.
  • Program participants are expected to provide accurate and truthful information. Providing false or misleading information may result in removal from the program.
  • TCHF does not provide legal advice, regulated financial advice, immigration legal advice, or medical advice through any of its programs. Information provided through our programs is general in nature and for educational purposes only.
  • TCHF does not guarantee any specific outcome, result, or benefit from participation in any program, including but not limited to employment placement, immigration outcomes, resolution of consumer disputes, or health outcomes.

5. Donations

All donations to TCHF are processed securely through Stripe, a PCI-DSS compliant payment processor. By making a donation, you agree to the following:

  • All donations are final and non-refundable, except where required by applicable law or at the sole discretion of TCHF.
  • TCHF will issue official CRA tax receipts for eligible donations in accordance with the Income Tax Act (Canada) and CRA guidelines. Tax receipts are issued for donations of $20 or more, unless otherwise required by law.
  • TCHF retains full discretion over the allocation of donated funds across its charitable programs and operations, unless a specific designation is agreed to in writing.
  • TCHF does not store your payment card information. All payment data is handled directly by Stripe in accordance with Stripe's own terms of service and privacy policy.
  • You represent and warrant that you are authorized to use the payment method provided and that all payment information you supply is accurate and complete.

6. Volunteer Activities

By applying to volunteer with TCHF, you acknowledge and agree that:

  • Volunteer activities are performed on a purely voluntary basis. No employment relationship, agency, partnership, or joint venture is created between you and TCHF.
  • TCHF may accept or decline any volunteer application at its sole discretion and may terminate a volunteer's participation at any time and for any reason.
  • You assume all risk of personal injury, property damage, or loss arising from your participation in volunteer activities, except to the extent caused by TCHF's gross negligence or wilful misconduct.
  • You agree to comply with all TCHF policies, procedures, and instructions provided to you in connection with your volunteer activities.

7. Intellectual Property

All content on this Website, including but not limited to text, graphics, logos, images, icons, photographs, audio clips, video clips, data compilations, page layouts, underlying code, and software, is the exclusive property of TCHF or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

The TCHF name, logo, tagline ("Caring for Our Community, Nurturing Hope"), and all related names, logos, product and service names, designs, and slogans are trademarks of TCHF. You may not use these marks without our prior written permission.

You may view, download, and print pages from the Website for your personal, non-commercial use only, provided that you do not modify the content and you retain all copyright and proprietary notices. Any other use, including reproduction, modification, distribution, transmission, republication, display, or performance, without our prior written consent is strictly prohibited.

8. User Submissions

Any information, materials, or content you submit through the Website — including through contact forms, program registrations, volunteer applications, help requests, or any other communication (collectively, "User Submissions") — shall be treated in accordance with our Privacy Policy.

By submitting any User Submission, you represent and warrant that: (a) you own or have all necessary rights to submit the content; (b) the content is accurate and not misleading; and (c) the submission does not violate any applicable law or infringe upon the rights of any third party. You are solely responsible for the content of your submissions.

9. Disclaimer of Warranties

THE WEBSITE AND ALL CONTENT, MATERIALS, INFORMATION, SERVICES, AND PROGRAMS MADE AVAILABLE THROUGH THE WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

To the fullest extent permitted by applicable law, TCHF expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement
  • Warranties that the Website will be uninterrupted, error-free, secure, or free of viruses or other harmful components
  • Warranties regarding the accuracy, reliability, completeness, or timeliness of any content, information, or materials on the Website
  • Warranties regarding the results or outcomes of participation in any TCHF program

Any reliance you place on information provided on or through the Website is strictly at your own risk. TCHF does not warrant that the information on the Website is appropriate or available for use in all jurisdictions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TCHF, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, VOLUNTEERS, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of, or inability to use, the Website or any services or programs offered through the Website
  • Any content, information, or materials obtained from or through the Website
  • Unauthorized access to or alteration of your transmissions or data
  • Any conduct or content of any third party on or related to the Website
  • Any errors, omissions, interruptions, deletions, defects, delays, or other failures in the Website
  • Your participation in any TCHF program, including but not limited to any personal injury, property damage, or financial loss arising therefrom

IN ANY EVENT, TCHF'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE WEBSITE SHALL NOT EXCEED THE LESSER OF: (A) THE AMOUNT YOU HAVE PAID TO TCHF, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100.00).

Nothing in these Terms excludes or limits TCHF's liability for death or personal injury caused by its gross negligence or wilful misconduct, or for any other liability that cannot be excluded or limited under applicable Ontario or Canadian law.

11. Indemnification

You agree to indemnify, defend, and hold harmless TCHF and its directors, officers, employees, agents, volunteers, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable legal fees) arising from or related to: (a) your use of the Website; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any User Submission you provide. This indemnification obligation shall survive the termination of these Terms and your use of the Website.

12. Third-Party Links and Services

The Website may contain links to third-party websites, services, or resources, including but not limited to payment processors (Stripe), social media platforms, government websites, and partner organizations. These links are provided for your convenience only. TCHF does not endorse, control, or assume any responsibility for the content, privacy policies, terms of service, or practices of any third-party websites or services. Your interactions with third-party websites are solely between you and the third party, and TCHF shall have no liability arising from such interactions.

13. Governing Law and Jurisdiction

These Terms and any dispute arising out of or in connection with them or the use of the Website shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario, sitting in the Regional Municipality of Halton or the City of Toronto, for the resolution of any dispute arising out of or in connection with these Terms. You waive any objection to the venue or jurisdiction of such courts, including any objection based on inconvenient forum.

14. Dispute Resolution

Before initiating any legal proceeding, you agree to first contact TCHF at info@tchf.ca and make a good-faith effort to resolve the dispute informally within thirty (30) days. If the dispute cannot be resolved informally, either party may pursue legal remedies in accordance with Section 13.

15. Modifications to Terms

TCHF reserves the right to modify, amend, or replace these Terms at any time in its sole discretion. Changes will be effective immediately upon posting on this page with an updated "Last updated" date. Your continued use of the Website after any such changes constitutes your binding acceptance of the revised Terms. It is your responsibility to review these Terms periodically. If you do not agree to the modified Terms, you must discontinue use of the Website.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TCHF with respect to your use of the Website and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and TCHF.

18. Waiver

No failure or delay by TCHF in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or remedy preclude any other or further exercise thereof or the exercise of any other right, power, or remedy.
